Terms of Use

1. General Provisions

By registering for, or using, the electronic services provided by CARGOTRANS, you agree to these Terms of Use. These Terms outline the rights, responsibilities, and obligations between CARGOTRANS and its Users. By completing registration, you confirm that you have read, understood, and accepted these Terms.

We recommend keeping a copy of these Terms for reference, as they may serve as evidence in case of a dispute.

2. Description of Services

Registration for CARGOTRANS services, including access to the Members Directory, is free of charge. Non-paid services include receiving notifications of available transport offers by email (Truck offers via TransNet and Cargo offers via CargoNet).

All offers submitted through the platform are intended solely for consultation and to facilitate agreements between Freight Forwarders and Hauliers.

CARGOTRANS may modify these Terms, website design, or service offerings at any time without prior notice. Such changes take effect on the day they are published. Users are not obligated to pay for newly introduced paid services unless they explicitly agree.

3. Service Scope and Availability

Users may advertise and view unlimited cargo and truck offers (land transport) 24/7 after successful registration and, where applicable, prepayment for CargoNet or TransNet services.

Service interruptions may occur during maintenance, weekends, or due to technical issues beyond CARGOTRANS' control.

4. Payment and Use of Paid Services

Full access to CARGOTRANS services requires prepayment for a defined period. Accounts expire automatically if not renewed at least 24 hours before the end of the prepaid period.

Accepted payment methods include bank transfer and cheque. Credit card payments are not currently supported. CARGOTRANS may update payment methods at any time without prior notice.

Free-of-charge coupons, if issued, remain valid and binding. In case of change of ownership, the new owner must honor existing coupon agreements. Users cannot be charged for past or future free services unless they agree.

5. User Responsibilities

• Ensure adequate hardware, software, and internet connection to access services.
• Maintain up-to-date antivirus and anti-malware software on devices used to access the platform.
• Keep login credentials secure and confidential. Notify CARGOTRANS immediately in case of suspected misuse.
• Keep profile information accurate and updated. CARGOTRANS is not liable for inaccurate user data.

6. Privacy and GDPR

CARGOTRANS handles personal data in accordance with applicable data protection laws, including GDPR (EU 2016/679). Data is processed solely for legitimate purposes such as:

• Account creation and management,
• Provision of platform services (CargoNet/TransNet),
• Communication regarding offers or service updates,
• Fraud prevention and legal compliance.

Users have the right to access, correct, delete, restrict processing, request data portability, or object to processing by contacting CARGOTRANS. Data is retained only as long as necessary to fulfill these purposes or comply with legal obligations.

7. Fulfilment of Obligations Between Users

Users entering agreements through CARGOTRANS are solely responsible for meeting all contractual and legal obligations. CARGOTRANS may suspend or terminate accounts of users violating these Terms and may notify affected parties.

Electronic records on the platform have the same legal effect as written documents.

8. New Services and System Updates

CARGOTRANS may introduce new services or modify existing ones at any time. The company is not responsible for data loss resulting from system updates or platform redesigns.

9. Intellectual Property

All content, design elements, and source code of the CARGOTRANS platform are protected by intellectual property law. Copying, distributing, or modifying any part of the platform without written permission is strictly prohibited.

10. Termination

Users may terminate their subscription at any time. Fees already paid are non-refundable, even if the service is terminated before expiration. CARGOTRANS may terminate accounts immediately in case of violations.

CARGOTRANS is not liable for damages arising from use of its services, including loss of profit, business opportunities, insolvency, or bankruptcy, even if previously notified.

11. Governing Law and Jurisdiction

These Terms are governed by Slovenian law. Any disputes will be resolved by the competent courts of Slovenia, with the District Court of Novo mesto having exclusive jurisdiction. Translations into other languages are for informational purposes only.
