Regulation on Working Hours and Rest Periods for Drivers

This regulation defines clear rules on daily and weekly rest periods, breaks, compensations, and internal monitoring of drivers’ working activities in accordance with EU Regulation 561/2006.

Daily Driving Time and Breaks

  • Maximum daily driving time: 9 hours (up to 10 hours twice per week).
  • After 4.5 hours of driving, a mandatory break of 45 minutes is required, which may be split into 15 + 30 minutes.
  • Daily rest between driving periods: at least 11 hours; once per week it may be reduced to 9 hours.

Weekly Rest

  • Standard weekly rest: at least 45 hours.
  • A reduced weekly rest of 24 hours is permitted, but the missing hours must be compensated by the end of the third week.
  • If two consecutive weekly rests are reduced, compensation becomes mandatory so that the total reaches 45 hours + the difference.
  • It is recommended that rest is taken in accommodation facilities or a suitably equipped vehicle.
  • In two consecutive weeks, total driving time must not exceed 90 hours.

Breaks During Driving

  • If the driving period exceeds 4.5 hours, a break is mandatory: 45 minutes (may be split).
  • Breaks ensure safety, prevent fatigue, and improve overall efficiency.

Supervision and Administration

  • Drivers must maintain a driving log (digital or paper), recording driving times, breaks, and rest periods.
  • The company monitors compliance with the prescribed rules and ensures proper supervision of rest times.
  • The company, as part of internal control, must regularly monitor drivers’ working activities, including collecting tachograph card data:
    • Data from the driver card and vehicle are reviewed every 4 weeks.
    • A full review and archiving of data for all drivers is performed at least every 3 months.
    • Regular monitoring enables timely detection of irregularities and appropriate corrective action.
  • Violations of the rules are handled in accordance with internal procedures and EU legislation.
